Justice must not only be done. It must be seen to be done and the international community has thus far denied justice by selectively targeting the have-beens and could-have-been little dictators and foemer dictators that are spread across the globe.
Instead of enpowering the ICC to hold every single abuser to account for his or her actions, no matter from whichever country they may come, the international community has provided the ICC with very few powers in order to satisfy a few countries with less than perfect human rights records. Mr Luf is correct by saying that the ICC is a farce.

Hi Harrie.
You just metioned exactly what is wrong with the ICC. Its limitation ie. its selectiveness.
And yes, I have read the Rome declaration and more than once and I am more than aware that the limitations put upon the ICC are hampering its operational functions. I am of the view that the ICC's prime rule, which is to reflect international justice on behalf on those having been the subject of injustice exacted by the likes of Mugabe, Bush and company, has been diluted into a farce. I am also of the view that, in order to reflect true international justice, the ICC needs to be truly independent. As I mentioned, it is not at the moment and that needs to change.
Regards
Henk

The reason why the ICC hasnt indicted President Bush is because the alleged crimes he is accused of do not satisfy the criteria laid down in the Rome Statute. Perhaps you should read the Prosecutor's reply on this issue. The ICC can't do right for doing wrong. People criticize it for being too unconstrained and then at the same time say things the above article. People need to make up their minds. Do they want the Court to run within its pre-assigned limits or do they want it to indict everyone without any regard for what the powers the ASP has given to it?
